The
Colleyville Planning & Zoning Commission unanimously recommended
approval of a Special Use Permit for alcoholic beverage sales for
on-premise consumption for Miguelito's Restaurant at their July 9
meeting.
The owners of the restaurant, located at 5224 Colleyville
Boulevard, presented a petition to the city in support of the request
containing over 1,850 signatures.
The Colleyville Land Development Code requires a Special Use
Permit for alcohol sales, and also requires that places that serve
alcohol be located at least 1,000 feet away (measured front door to
front door) from a public school, church or hospital.
Because the restaurant is located just south of First Baptist
Church of Colleyville, the distance was measured by Brittain &
Crawford surveyors and shown to be 824.56 feet.
Although
no one was present to speak against the request at the public hearing, a
written protest was delivered to the city on Monday, July 9, to be read
into the public record at the meeting by First Baptist Church of
Colleyville.
In
other business the Commission also unanimously recommended approval of a
Special Use Permit for a convenience store with gasoline sales and
alcoholic beverage sales for off-premise consumption requested by the
owners of the Albertson's at 4841 Colleyville Boulevard.
The applicant proposed a 1,989 square foot convenience store with
beer and wine sales and four gas pump islands.
The facility would be located at the southeast corner of Village
Park Drive/Glade Road and Colleyville Boulevard.
Both of the Special Use Permit requests (Miguelito's and
Albertson's) will now go to the City Council for public hearings and
final action.
Approval
was also recommended for an amendment to the Land Development Code
regarding regulations for landscaping setbacks on Colleyville Boulevard.
A suggestion had been made by the State Highway 26 Corridor
Committee to require a twenty-foot wide landscape strip at the front of
each commercial development that abuts the boulevard.
The committee was appointed by the City Council last year to help
develop design regulations for Colleyville Boulevard in conjunction with
the widening and improvements planned for State Highway 26 by the Texas
Department of Transportation.
The current landscape requirements are based on the size of the
property and do not ensure uniform depth of landscaping along the
boulevard.
The amendment will provide a more balanced appearance for
landscaping.
This proposed ordinance change will also be forwarded to the City
Council for action.
